These Terms & Conditions govern your use of Pay Monthly Websites and the website design services we provide. By enquiring about or using our services, you agree to these terms. Please read them carefully before proceeding.

1. Who We Are

Pay Monthly Websites is a web design business based in Manchester, England. We provide affordable, pay-monthly website design and management services for UK small businesses.

References to "we", "us" or "our" throughout these terms refer to Pay Monthly Websites. References to "you" or "your" refer to the customer using or enquiring about our services.

2. The Service

Pay Monthly Websites offers a managed website service that includes website design, hosting, maintenance, and ongoing support — all bundled into a single monthly payment. The service is structured as follows:

  • We design your website first, at no upfront cost to you.
  • You review the design before any payment is taken.
  • If you are happy with the design, you begin a monthly subscription to keep the website live and managed.
  • If you do not wish to proceed after reviewing the design, you pay nothing and walk away.

The specific features, page count, and support level included in your plan are determined by the package you select (Starter, Growth, or Pro). Full plan details are outlined on our Pricing page.

We reserve the right to update, improve, or adjust the features included in each plan over time. Where any such change materially affects your existing plan, we will notify you with reasonable advance notice.

3. Website Ownership

The website designed and maintained by Pay Monthly Websites remains the property of Pay Monthly Websites unless a separate written ownership agreement is made.

The service is structured as a website rental. You are paying for access to a professionally designed and managed website for as long as your subscription remains active. This model is what makes the £0 upfront design and no setup fees commercially possible.

  • If your subscription is cancelled or lapses, the website will be taken offline.
  • Website files, code, and design assets remain the property of Pay Monthly Websites.
  • Your business content (text, logos, images, and other materials you provided) remains your property.

Ownership buyout: In some cases, a website ownership buyout may be available upon request. This would be subject to a separate written agreement and an agreed fee. Please contact us to discuss this if it is something you require.

4. Payment & Billing

4.1 Monthly payments

Monthly payments are due on the same date each month, starting from the date your website goes live. All prices are shown in pounds sterling (GBP) and are inclusive of VAT where applicable.

4.2 Payment methods

We accept payment by direct debit, card, or bank transfer. We will confirm your payment method at the start of the service agreement.

4.3 Late or missed payments

If a payment is missed or fails, we will contact you to resolve the issue. If payment remains outstanding after 14 days, we reserve the right to suspend the website until payment is received. If payment remains outstanding after 30 days, we reserve the right to terminate the service and take the website offline.

4.4 Price changes

We may review our pricing from time to time. If we increase your monthly price, we will give you at least 30 days' written notice before the change takes effect. You have the right to cancel within this notice period without penalty if you do not wish to accept the new price.

5. Cancellation Policy

5.1 Cancellation by you

You may cancel your subscription at any time by providing us with 30 days' written notice via email to info@paymonthlywebsites.io. Your website will remain live and supported during the 30-day notice period.

There are no long-term contracts or exit fees. You will not be charged beyond the end of your notice period, provided all outstanding payments have been settled.

5.2 Cancellation by us

We reserve the right to terminate or suspend the service with 30 days' notice if:

  • Payments remain outstanding beyond 30 days despite contact from us.
  • You breach these Terms & Conditions in a material way.
  • We are no longer able to operate the service commercially.

In the event of cancellation by us without cause, we will refund any payments made for periods beyond the cancellation date on a pro-rata basis.

5.3 What happens to the website on cancellation

On cancellation by either party, the website will be taken offline at the end of the notice period. Your business content (text, images, logos) will be made available to you on request for up to 30 days after cancellation. After this period, all associated data may be deleted.

6. Our Responsibilities

As part of your monthly plan, we are responsible for:

  • Designing and building your website to a professional standard.
  • Hosting your website on a reliable server with reasonable uptime (we target 99.9% uptime, though this cannot be guaranteed).
  • Maintaining your website, including software updates and security patches, where applicable.
  • Providing SSL (HTTPS) to secure your website.
  • Being available for support queries 7 days a week and responding within one working day.
  • Making agreed changes to your website content in a timely manner.

We will aim to launch your website within approximately 7 days of receiving your approval and all required content. Delays caused by late content delivery or slow approval from your side are outside our control and may extend this timeline.

7. Your Responsibilities

As a customer, you are responsible for:

  • Providing accurate business information, content, and branding assets in a timely manner.
  • Reviewing and approving the website design within a reasonable timeframe.
  • Ensuring all content you supply to us (text, images, logos, trademarks) is owned by you or that you have the right to use it. You must not provide content that infringes third-party intellectual property rights.
  • Ensuring your website is used for lawful purposes only and does not contain content that is defamatory, misleading, or in breach of UK law.
  • Keeping your payment details up to date to avoid service interruption.
  • Notifying us promptly of any issues with your website.

8. Intellectual Property

8.1 Our intellectual property

The design, code, templates, and other creative work produced by Pay Monthly Websites remain the intellectual property of Pay Monthly Websites unless expressly transferred to you in writing. This includes all website design elements, custom code, and layout structures we create.

8.2 Your intellectual property

All content you supply to us — including your logo, brand assets, photography, written copy, and business information — remains your intellectual property. By providing this content to us, you grant Pay Monthly Websites a licence to use it solely for the purpose of designing, building, and managing your website.

8.3 Third-party assets

Where we use licensed stock photography, icon libraries, or third-party fonts as part of your website design, these remain subject to their respective licence terms. We will not use assets that are not properly licensed.

9. Limitation of Liability

To the fullest extent permitted by law, Pay Monthly Websites shall not be liable for:

  • Any loss of business, revenue, profit, or data arising from your use of or inability to use the website.
  • Any indirect, consequential, or incidental losses of any kind.
  • Downtime caused by third-party hosting providers, domain registrars, or factors beyond our reasonable control (including but not limited to force majeure events, cyberattacks, or infrastructure failures).
  • Search engine ranking changes or fluctuations, which are outside our control.

Our total liability to you in connection with these terms and the services we provide shall not exceed the total monthly fees paid by you in the three months preceding the event giving rise to the claim.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded or limited under UK law.

10. Changes to These Terms

We may update these Terms & Conditions from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you by email where appropriate.

Continued use of our services after any changes are notified constitutes your acceptance of the updated terms. If you do not agree to the revised terms, you have the right to cancel your subscription with 30 days' notice in accordance with Section 5.

11. Governing Law

These Terms & Conditions and any disputes arising from them are governed by the laws of England and Wales. Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
